High Level Overview Version

• Musicians can offer services (ie"Gigs") on MyMusicGig.com. These can be various services such as playing a bass or guitar track, or adding vocals for example. Buyers can hire established musicians to add tracks for their CD's or mp3's to be listed on iTunes, MySpace etc.  These usually will be accomplished in the sellers "home" studio. Established musicians can make a good side income, and buyers (producers of music) have an easy and cost effective way to get great musicians to  play on their recordings.
• Gigs on MyMusicGig are offered for fixed prices only: $10, $25, $50, $75, $100, $150 and $200 (United States Dollars).
• Only registered users can buy and sell on MyMusicGig. Registration is free. Click here to register! http://www.mymusicgig.com/signup
• You may not offer or accept payments using any method other than placing an order through MyMusicGig. Gigs should be ordered using the 'Order Now' button.
• Important: Buyers are granted all rights for the delivered work, unless otherwise specified by the seller in the gig description. Including all copyrights for your performace provided as part of the gig. Including any and all music/mechanical copyrights worldwide.
• No adult, warez, or illegal services/products!

General Terms

• You must first register for a free account in order to offer your services ie provide gigs on MyMusicGig.com.
• "Gigs" refers to products and services being sold. These should be related to specific talents that you have as a musician, especially relating to recording tracks for people.
• Gigs may be priced at $10, $25, $75, $100, $150 and $200. All gigs will be fixed prices only. This makes it easy for buyers of the services as well. MyMusicGig is all about simplicity in the buying/selling process.
• All identities on MyMusicGig are to be kept anonymous. No exchanging email or other contact information.
• No direct payments for gigs bought and sold on are allowed. MyMusicGig brings together buyers and sellers of musician services and provides the servers needed for download/upload.
• All material posted on this site must be original and the owner of the poster; no copyrighted, adult audience, violent content or offensive or hateful material will be allowed. As Redfoo said, "hating is bad"!
• Posting any prohibited content or disobeying the above rules will result in your account being permanently terminated.
• Below is the table showing the commission amounts (NOTE: Credit card/Paypal charges are included in and taken out of the commission not the seller amount).

Note for musicians offering gigs:

Offering gigs on MyMusicGig.com is a great way to earn side income while you aren't touring or during a "down time".  (How many $100 gigs do you need to do a day, to make a big difference in your monthly income?  And afterall, adding something like a guitar track to a song, doesn't take very much time itself, and can all be done in the comfort of your home studio!)

Once you create your gig on MyMusicGig, you then should promote your gig, by tweeting your gig to Twitter and posting to your Facebook page.  Our website makes this easy to do.  This is what helps bring in your customers.  The bigger the following you have as a musician, the more you can charge for your gigs!  Also, please remember, the value of listing on MyMusicGig, is also for the "cross-pollination" that occurs.  Someone coming in for a pedal steel player might see your offering for a slide guitar gig (for example) and also decide to hire you for the song they are producing.

Payments

•  Buyers purchasing a gig are required to pay in advance. You will use your Paypal account or pay by credit card through Paypal.
• Once the product or service is completed and sent to the buyer, seller amount (see above) will be deposited into your MyMusicGig balance.
• Once you have a balance in your account, you will be able to request a withdrawal via Paypal.
• Please allow up to 72 hours for payout requests to be processed.

The Order Process

• If a buyer purchases a gig from you, an email will be sent to you; you can then either Accept or Reject the purchase. If you are unable to handle orders for a period of time, you can temporarily cancel your gigs from your user control panel.
• If you have not responded to the email within 24 hours MyMusicGig will automatically cancel the order.
• You can increase your positive feedbacks by responding to order requests quickly, and by answering questions as asked by potential buyers.
• You also will need to offer modifications per the buyers request, just like you would in a studio setting, where the producer or artist requires changes, and other takes.

Staying Out of Trouble

• Please Note: As part of choosing a preferred provider of music services, you'll want to check out the sellers homepage so that you know of their accomplishments musically. This can be done by viewing YouTube videos and more. The musician may even be a "famous" muscian. However, once you hit the "buy" button we ask that you only use MyMusicGig to manage the gig. Of course in some instances you may know of or have heard of the musician and that is fine (and also why our website is such a great service), however anyone trying to circumvent our system will ultimately be banned from using the service. We ask for your co-operation in this matter.

• Sellers and buyers identity is kept anonymous. Requesting or providing Email addresses, IM/Skype usernames or any other personal contact details (other than your name) is prohibited.

• All communications, information and files exchange should be performed exclusively using MyMusicGig.com's messaging system.

• Posting or sending copyright protected, adult, illegal, rude, abusive, promotional, spam, violent, hateful, or any improper material is strictly prohibited. Doing so will get your account blocked permanently.

Delivering Orders

• To protect users privacy, all communication on MyMusicGig must go through MyMusicGig's mail system.
• All users are responsible for file contents; MyMusicGig shall not be held liable for any damages caused by harmful files. Use a virus scanner to check all files before downloading.
• MyMusicGig is not responsible for any loss of files during or after the gig has been completed. Please make sure that you have files backed up as a matter of course. IMPORTANT: We DO NOT guarantee backup of any files at ANY time, this is the responsibility of the buyer and seller.

Feedback Score 

Each gig's feedback is formulated by your buyer's feedback and how quickly you responded to the order.

Withdrawing Funds 

• An active Paypal account is required to receive payments from MyMusicGig.

• Funds are available for withdrawal 14 days after they are deposited in your account. There is a fee of the total withdraw sum. Paypal charges the withdraw fee and MyMusicGig does not make money from your withdrawal.

• Make sure your Paypal email address on account is correct and check the correct box, as withdrawals are final and can't be reversed.

Buyer

Ordering Gigs

• Gigs on MyMusicGig are purchased via PayPal or a valid credit card (no PayPal account required).
• Your purchase is not sent to the service provider until payment has cleared.
• Your order can be canceled anytime prior to the service provider acceptance; once he or she accepts your order, it is too late to cancel your purchase.
• Service providers may reject your order if they cannot complete it on time. If this happens with your order, the funds will be placed in your MyMusicGig account and will be available for purchasing other gigs on MyMusicGig.
• Exchanging emails or other contact information is strictly prohibited.
• Transactions or payments conducted outside of MyMusicGig is prohibited and will get your account banned from our service.

General Terms of Service

• Anyone participating in spamming will have their IP address permanently banned.
• There is only one account allowed per person. Never register more than one account per person. Doing so will get your account permanently banned.
• It is prohibited to use proxy servers to access MyMusicGig.com and/or buy/sell gigs via proxy servers. We do not allow access through VPN accounts as a rule.
• If you have a dispute with a seller, use our contact form (see below). Never use PayPal to reverse or request refund of the payment to MyMusicGig. Doing so will get your account suspended. Always contact our friendly support!
• MyMusicGig reserves the right to suspend or terminate any account that violates our terms and policies. Users with accounts on hold will not be able to sell or buy on MyMusicGig.
• Violation of MyMusicGig Terms of Service may get your account permanently blocked.
• Sellers will be able to withdraw their revenues from blocked accounts after a safety period of 45 to 90 days, depending on block reason, from day of last cleared payment received in their account and subject to MyMusicGig approval.
• MyMusicGig.com may make changes to its Terms of Service from time to time. When these changes are made, MyMusicGig will make a new copy of the Terms of Service available at http://www.mymusicgig.com/terms_of_service.
• You understand and agree that if you use MyMusicGig.com after the date on which the Terms of Service have changed, MyMusicGig will treat your use as acceptance of the updated Terms of Service.

Disputes

• We encourage our buyers and sellers to resolve issues between themselves. If for any reason this process fails, you can contact us using our contact us page.
• If necessary, refunds will be deposit funds into your MyMusicGig account, not refunded to your PayPal account. We cannot refund money to you in any other way.

DISCLAIMERS; LIMITATIONS AND EXCLUSIONS OF LIABILITY

A.  No Warranties

OUR SERVICES AND THE MyMusicGig.com WEBSITE ARE PROVIDED "AS IS." TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, MyMusicGig AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, NON-INTERFERENCE, SYSTEM INTEGRATION AND ACCURACY OF DATA.  APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.  MyMusicGig AND ITS AFFILIATES DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.  THE SUBMISSION OF ANY PERSONAL INFORMATION AND THE DOWNLOAD OR UPLOAD OF ANY MATERIAL THROUGH THE SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK. YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT MAY RESULT FROM THE DOWNLOAD OR UPLOAD OF ANY MyMusicGig MATERIALS OR FROM USE OR RELIANCE UPON THE SERVICES.  MyMusicGig IS NOT THE PROVIDER OF ANY THIRD-PARTY OFFERINGS AND MAKES NO WARRANTIES WITH RESPECT TO THEM.  MyMusicGig DOES NOT GUARANTEE THE SECURITY OF ANY INFORMATION TRANSMITTED TO OR FROM THE SITE, AND YOU AGREE TO ASSUME THE SECURITY RISK FOR ANY INFORMATION YOU PROVIDE USING THE SERVICES.

B. Your Use of Content

YOU UNDERSTAND THAT THE CONTENT AVAILABLE THROUGH THE SITE IS PROVIDED TO MyMusicGigFROM A VARIETY OF SOURCES.  YOU ACKNOWLEDGE AND AGREE THAT WE ARE NOT RESPONSIBLE FOR THE ACCURACY OR USEFULNESS OF THE CONTENT, AND THAT YOU MAY BE EXPOSED TO CONTENT THAT IS INACCURATE, OFFENSIVE, INDECENT, OR OTHERWISE OBJECTIONABLE.  WE DISCLAIM ANY REPRESENTATIONS OR WARRANTIES THAT THE CONTENT IS NON-INFRINGING.  YOU WAIVE ANY LEGAL AND EQUITABLE REMEDIES THAT YOU HAVE OR MAY HAVE AGAINST MyMusicGig WITH RESPECT TO THE CONTENT, AND YOU AGREE TO INDEMNIFY AND HOLD HARMLESS MyMusicGig, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES AND AGENTS FROM AND AGAINST ALL DAMAGES, EXPENSES AND LIABILITIES ARISING FROM YOUR USE OF THE SERVICES AND THE MyMusicGig MATERIALS.

C.  Limitation Of Liability

USE OF THE SERVICES AND THE MyMusicGig MATERIALS IS AT YOUR OWN RISK.  IN NO EVENT WILL MyMusicGig OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES IN CONNECTION WITH THE SERVICES, AND/OR IN CONNECTION WITH THESE TERMS, WHETHER OR NOT SUCH DAMAGES WERE FORESEEABLE, EVEN IF MyMusicGig WAS ADVISED THAT SUCH DAMAGES WERE LIKELY OR POSSIBLE.  IN NO EVENT WILL THE AGGREGATE LIABILITY OF MyMusicGig TO YOU FOR ANY AND ALL CLAIMS ARISING IN CONNECTION WITH THE SERVICES, EXCEED ONE DOLLAR (U.S. $1.00).  YOU ACKNOWLEDGE THAT THIS LIMITATION OF LIABILITY IS AN ESSENTIAL TERM BETWEEN YOU AND MyMusicGig RELATING TO THE PROVISION OF THE SERVICES, AND YOU FURTHER ACKNOWLEDGE THAT MyMusicGig WOULD NOT PROVIDE THE SERVICES TO YOU WITHOUT THIS LIMITATION.

D.  Indemnification

YOU AGREE TO INDEMNIFY, HOLD HARMLESS MyMusicGig, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM AND AGAINST ALL DAMAGES, EXPENSES, AND LIABILITIES, INCLUDING REASONABLE ATTORNEYS' FEES, ARISING IN CONNECTION WITH YOUR VIOLATION OF THESE TERMS.
